Amendment to the Labour Code and OKbase

The amendment to the Labour Code was published in the Collection of Laws on 19 September 2023. On the same day, we released a new version of the OKbase HR system for our customers, which contains the incorporated changes effective from 1 October 2023.

 

Incorporation of legislative innovations into the OKbase HR solution

In the detailed documentation, which is available in the dedicated client section, OKbase customers will find an overview of possible situations and a suggestion on how to set everything up correctly in the system for employees working on a work agreement and a performance agreement so that the subsequent calculation of their remuneration is carried out correctly. These include the following functionalities:

- Entering the hours, working time and other parameters for agreements;

- the possibility to record zero weekly working hours for agreements;

- bulk generation of time sheets;

- reimbursement for working from home (only used for those employers who have agreed reimbursement with their employees, the item is not eligible and therefore not automatic in the new version of OKbase).

 

Where to find interpretation and recommendations on the new legislation?

We discussed the forthcoming amendment during the OKbase Day 2023 customer conference with an external expert in employment law, Mr. Morávek from Felix and Co. This event took place in May 2023. During the lecture "The amendment to the Code under scrutiny" doc. JUDr. Jakub Morávek, Ph.D. provided an explanation of the upcoming changes.

Now that the amendment has been passed, it is currently responding and recommending that all employers review 10 key company documents and related processes in light of the amendment:

  1. information provided to employees at the commencement of employment or a work performance or work activity agreement;
  2. information provided to employees when the underlying employment relationship changes as described in the previous point;
  3. the wording of the employment contract;
  4. the text of the agreement to perform work;
  5. the text of the agreement on the performance of work;
  6. the text of the agreement and of the internal rules governing the performance of telework;
  7. the rules on service of process;
  8. the creation of an informed consent for the delivery of documents to the employee's own hands by electronic mail;
  9. the establishment of rules and processes for the exercise of new rights by employees - application for employment by an employee performing work under a work performance or work activity agreement, application for teleworking, application for reduction of working time or adjustment of working hours by an employee entitled to special working conditions, etc.;
  10. rules relating to the taking of parental leave.

Digital signing

 

The amendment specifies the requirements for digital signing and delivery of electronic documents and thus allows for a greater expansion of digital signing not only of employment law documents.

At OKbase, we implement all types of electronic signatures used – from plain to qualified, in cooperation with our partner solution Obelisk Signing Portal from SEFIRA. The solution is described by SEFIRA expert Martin Jurík in a short video.
